新《民事诉讼法》确立的视听传输技术作证,是在网络技术进步强势影响社会生活的背景下产生的,反映了法律实用主义考量的因素,目前尚缺乏对其深入的理论分析。探究视听传输技术作证的性质、功能、规则制度以及适用方式,有赖于"三对关系"视角的透视,即:网络技术与民事司法的关系、视听传输技术作证与其他庭外作证手段的关系、视听传输技术作证与民事诉讼程序诸原则的关系。这些关系的厘定,构成该作证方式制度完善及实践运用的基础。

Audio-visual transmission technology for testimony was established in the newly amended Civil Procedure Law, and was produced under the background of the strong influence of the network technology advance on the social life. This way of testifying reflects the factors of considering the le- gal pragmatism, but it still lacks an in-depth theoretical analysis. Exploring the audio-visual trans- mission technology for testimony with its nature, function, rule system and the applicable way de- pends on the analyses from the perspective of ＂three relationships＂, namely the relationship between network technology and civil justice, audio-visual transmission technology and other ways to give tes- timony out of court, audio-visual transmission technology and the principles of the civil procedure. Determining these relationships constitutes the basis of perfecting the audio-visual transmission tech- nology for testimony and its practical application.
