A New Idea on Works Utilization——Creative Commons

知识共享协议的宗旨是希望他人能更方便地使用现有作品,促进新作品的产生,并且丰富社会大众的精神生活。与合理使用制度、法定许可使用制度相比,知识共享协议允许在更大范围内使用作品,配合著作权发挥功效并减少著作权侵权的发生,因此,我们可以在一些领域中对该协议予以先行先试,以促进社会的发展。但是,由于作者对遵循协议的作品依然享有著作权,因此在使用作品时,使用者必须尊重作者的意愿,否则仍会构成侵权。

The aim of Creative Commons is to facilitate the use of existing works, to promote the creation of new works and to enrich the masses＇ spiritual life. Compared with Fair Use System and Statutory License System, Creative Commons allows users to utilize works in a larger scale, acts in concert with the copyright and minimizes its infringement. As a result, we can use Crea- tive Commons in some areas at first to enhance the development of our society. However, the au- thors still own the copyright of the works according to the Creative Commons, so users must re- spect their will when using their works, otherwise they will be charged with infringement.
