电子商务并未动摇现行法律赖以存在的基础,经营主体强制工商登记制度仍适用于电子商务活动中。《网络交易管理办法》中自然人网店工商登记的规定,是对经营主体强制登记制度的"规避"。基于商主体真实、保障电子商务交易安全、服务于市场管理和构建电子商务诚信体系的需要,电子商务法应规定自然人网店强制登记制度。工商登记不是赋权,而是对商自然人网上经商权的确认。自然人网店登记的内容包括自然人的身份信息、住所、联系方式等。自然人身份信息的核实依赖于全国范围的可信身份体系建设。

E-commerce didn＇t change the rule of law,which means mandatory registration system still runs in e-commerce behaviors. The clause concerns about business registration of online store established by natural persons stipulated in ＂Measures for the Administration of Online Transactions＂is conflict with mandatory registration system. As to meet the requirements of basic rules such as ＂authentic subject＂,＂secure the e-transaction＂,＂subject to market management＂,＂make up a e-commerce credit system＂,e-commerce law shall include the mandatory registration system of online shop established by natural persons. Business registration is confirmation about online transaction right of natural persons,rather than right empowerment. The registration of natural persons＇ online shop includes identity information,domicile and contact information of the said natural persons. The verification of identity information is built upon a national wide authentic identity information system.
