社会安全突发事件法律应对机制探讨

On the Legal Mechanism of Social Security Incidents

目前,我国应对社会安全突发事件的法律机制存在着立法不完善、《宪法》对事件中权利的限制与扩大规定的不足、行政执法程序与监督上存在缺陷、信息公开不及时准确等问题。因此,应在分析现状的基础上,借鉴国外法的先进作法,完善相应立法和法律制度、规范行政执法程序、完善各部门联动机制、完善信息公开制度等,以此健全我国的社会安全突发事件的法律机制。

At present, there exists some deficiency in Chinals legal system to deal with the emergency of social security mainly including imperfect legislation, incomplete regulation in the limitation and the expansion of the rights issued in Constitution, defects in the enforcement procedures and supervision of administrative law, not timely and inaccurate information disclosure. Therefore, in order to improve the legal mechanism of social security emergencies, this paper makes an analysis on the present status and puts forward some countermeasures as following： learning from foreign advanced practice; improving the relevant legislation and legal system; standardizing administrative law enforcement procedure; improving the linkage mechanism among related departments, and perfecting the information discourse system.
