和谐社会背景下的村民自治与民间法关系的法社会学分析

The Analysis of Sociology of Law on Relationship between the Villager Autonomy and Folk Laws under the Background of Harmonious Society

在法社会学的视角下,我国部分农村地区的民间法有其特定的范式及内容,其与村民自治制度之间存在既相互借鉴又相互冲突的共生关系。基于对现状与问题的考虑,需要合理界定二者的边界,明确各自作用范围,在不违背现有法律规定与原则的前提下,应重视民间法的独特价值,为其提供产生效用的空间与土壤。

From the perspective of sociology of law,folk laws of some rural areas in our country have their own normal forms and contents.And they have a symbiotic relationship with the villager autonomy system,which can learn from each other and also conflict with each other.On the basis of considering the status quo and problems,it is necessary to confinn the two parties＂ limit in a rational way,to clear each other＇s function range.On the premise of not violating current legal provisions and principles,it should attach importance to the unique value of folk laws and provide them with space and soil to be effective.
