禁止权利滥用原则相关问题探析

Analysis of the Difference from the Principle of Prohibition of Rights Abuse and the Principle of Honesty and Credit

凡权利皆受限制,无不受限制的权利。任何民事权利都应限定在法律规定或当事人约定的范畴之内。本文从权利滥用的判断标准、具体情形、法律效果、与诚信原则的关系等方面对权利滥用的禁止进行了探讨。在借鉴国外相关法律规定的基础上,尝试对我国相关法律进行完善。

All rights should be limited .Any civil rights should be limited within the category of prescribed by law or agreed by the parties .In this paper ,the principle of right abuse of prohibited are discussed from the judging standard ,the specific sit‐uation ,the legal effect ,the relationship of the abuse of rights with the good faith .On the basis of the experience of foreign rel‐evant legal provisions ,the paper tries to perfect the related laws in china .
