摘要
面对我国实践中业已出现的过程性信息是否公开的争议,学界并未达成共识性意见,当前的法规范也未提供问题的解决空间。考察相关司法判决可发现,法院在该问题上曾经长期采取绝对不公开的态度,而最新判决赵正军案则提出了部分不公开的司法判断。着眼于挖掘具有普适意义的司法判断和对未来司法判断的建构,应当着重探讨过程性信息公开司法审查的关键点与疑难点。其中,关键点是将"依法行政"定位为司法审查的依据,明确厘清不公开的例外情形;疑难点是发现适用"依法行政"时所产生的无法消解的利益冲突并借助利益衡量方法从适用场合、适用原则、利益甄别和利益判断等环节展开分析。过程性信息的公开会随着国情社情的沿革,朝着制度化、常规化的方向发展。
The academic world has not reach a consensus on the dispute of whether procedural information should be disclosed arisen in reality and practices, however, current legislation may not be able to develop any space for solution of any kind either.After exploration of relevant judicial verdicts, you will find that the court used to firmly hold that procedural information should be subject to non-disclosure, however, the Zhao Zhengjun Case bring up a new point that not all procedural information should not be able to disclose. Focusing on developing judicial decision which could be followed generally and reconstruction of judicial decision in the future, the key point and difficult point of judicial review on procedural information shall be especially discussed.The key point is to deem 'Rule of Law' as the basis of judicial review and explicitly clarify the excluded situations of non-disclosure; the difficult point shall mean discovering the interests conflicts arisen in the adoption of 'Rule of Law' and analyzing these conflicts from different aspects including but not limited to applicable situation, applicable principle, interest identifying and interest judgment, through interest weighing measurement. Disclosure of procedural information would be developed more institutionally and normally as the evolution of conditions of state and society.
