上海市依法行政综合评估体系研究

Research on Evaluation Indicator System of Administration by Law: Based on Data Analysis in Shanghai

依法行政评估指标体系是对政府法治建设实践的重要标尺,也是推进理想法治政府模式的基本手段。文章构建了由1个一级指标、8个二级指标、36个三级指标组成的依法行政指标体系。在此基础之上,对上海市64个行政部门的依法行政状况进行了测评,结果显示:各单位对单项指标的推进力度存在不均衡现象,依法行政整体推进力度存在明显差别,"条""块"单位在依法行政中存在较为明显差异性。对此,应强化政府信息公开制度的实施,从"条""块"碎片化治理走向协同治理,"内外兼治"补齐"依法行政"之短板。

The evaluation indicator system of administration by law is not only a eritieal landmark of construction of the government legal system, but also an important means of promoting the ideal governmental model of the rule of law. This paper constructs an evaluation indicator system of government administration on the basis of a one-level indicator, 7 two-level indicators, and 36 three-level indicators. On this basis, 64 administrative departments in Shanghai are measured. The results show that the efforts exerted in promoting the indicators are different from department to department, so is the ease in the overall promotion of administration by law. In this regard, the government should strengthen the implementation of information disclosure system, better their performance from the fragmented governance to collaborative governance, and overcome the shortcoming in ＂administration by law＂ with ＂ governing both internally and externally＂.
