近代以来,"权利话语"逐渐成为这个时代的主题。尽管中国缺乏"权利本位"的传统,但改革开放之后,不论是在理论上,还是在司法实践中,"权利话语"都逐渐上升到了绝对强势的地位。但由于修辞技术的盛行、权利自身的不确定性及权利在行使时的过度扩张,"权利话语"频频自相冲突、陷入困境。深入研究"权利话语"冲突之缘由,化解权利碰撞之矛盾,有利于为正当权利之行使疏通道路。

When it comes to the modern history,＂right discourse＂is becoming the theme of the era.China has no tradition of＂right standard＂,but after the reform and opening policies,right discourse comes up to the mighty position gradually,no matter in theory or out of judicial practice.Whereas due to the prevail of rhetoric,the characteristics of uncertainty in right itself and the over expansion during excising right make the ＂right utterance＂contradict frequently,thus coming into a dilemma.A deep study of the reason for contradiction of ＂right discourse＂and solution to the contradiction of right collision will make road for exercising legitimate right beneficially.
