Analysis and suggestion of the patent status of the health sector in Shanghai

目的 :分析上海市卫生系统的专利状况。方法 :检索1990—2012年上海市卫生系统单位在我国申请的专利,分析专利数量、种类、权利要求数、专利被引数、维持寿命及专利转让/许可的情况及变化趋势。结果 :上海市卫生系统专利申请及授权数量逐年增长,近年来增长速度明显加快,近十年专利的权利要求数比以往增多,发明专利的绝对数量明显增加,但比例呈先增长后降低的趋势,维持较短寿命的专利比例增加,专利被引次数及专利转让数则始终维持在较低的水平。结论 :上海市卫生系统的知识产权工作取得了较大的进步,但其中低质量的成果也大量增加,建议加强专利成果的质量管理,促进转化,建立预审制度,优化知识产权的奖励机制,加强科研诚信建设,促使专利数量和质量的综合提高。

Objective：To assess patents protection status of Shanghai health sector. Methods：The patents applied by Shanghai health sector from 1990 to 2012 in China were retrieved and the patent number,kinds,claim numbers,forward citations,life,transfer and their tendency with time were analyzed. Results：The number of patents application and authorization increased obviously,and the growth speeded up in recent years. The average patent claim numbers also increased. However,the share of invention patents showed a decreasing trend after the initial growth and percent of the patents with short life kept rising. Forward citations and the transfer rate of patents always maintained in low level. Conclusion：The protection of intellectual property in the Shanghai health sectors has made great progress. However,the low-quality patents also increased largely. In the future,it is suggested that the quality management be strengthened and invents be estimated before patent application. It is also suggested that the incentives for intellectual property be optimized to promote the comprehensive improvement of patent quantity and quality.
