散杂居回族社会清真寺纠纷调解功能研究

Study of Mosques' Dispute Meditation Function in Dispersed and Mixed Hui Nationality Residence Areas

清真寺作为回族社会的政治文化交流中心,在散杂居回族社会民间纠纷调解过程中发挥着至关重要的作用,尤其是在避免司法资源浪费和保护穆斯林利益方面的作用更加显著。可是,随着城市化的深入和城市转型的加快,清真寺民间纠纷调解功能也面临着规范性不足、合法性质疑等发展瓶颈。因此,从回族社会宗教文化出发,充分发挥清真寺的核心作用,建立和完善合法、合理、规范的回族社区纠纷解决长效机制,对引导穆斯林群众避免纠纷、和谐守法、加强团结具有重要意义。

Mosques, as the political and cultural center of the Hui nationality community, play a crucial role in meditating disputes in dispersed and mixed residence areas, especially in avoiding the waste of judicial resources and protecting the interests of Muslims. However, with the acceleration of urbanization and urban transformation, Mosques＇ civil dispute mediation function is also facing regulatory deficiencies, and is questioned by the legality. Thus, based on the Muslim socio-religious culture, it＇s meaningful to enhance the central role of mosques, to establish and improve the legal, reasonable, normative, and long-term mechanism of disputes meditation in Hui nationality community, and to guide Muslims to avoid disputes, and to be harmonious, law-abiding, and united.
