交换领域外部性问题的经济法解决:以交易公平的经济法制保障为视域

Solution of Externality with Economic Law in the Area of Exchange of Goods:A Perspective of Securing Fair Transaction

当前我国经济法在协调交换领域外部性时主要面临负外部性的量化困难、外部性理论不足以及经济法制度存在缺陷等问题。文章在对经济法协调交换领域外部性面临问题的原因进行分析后表明,主要由于交换领域存在的信息不对称和代理问题,直接导致了经济法在协调交换领域外部性问题时面临困难,认为应当从建立衡量外部性的标准、充实外部性理论以及完善经济法制度等三个方面加强经济法在协调交换领域外部性问题中的作用。

In present, China＇s economic law caused with lots of factors in exchange of goods which included quantitative difficulties, theoretical problem and the defects of economic laws. After analyzing the causes of the economic law in the exchange of goods, it is clear that due to the information asymmetry and agency problem in the area of goods exchange resulting economic low faced with difficulties in coordinating problems. We should establish standards to measure externality, enrich theory of externality and improve the economic law system to strengthen the effects during coordinating problems in exchange of goods.
