地方法治:中国传统“封建”政治思路的现代表达

Local Rule by Law:the Modern Expression of the“Feudal”Political Ideology in Traditional China

近些年来,全国很多地方相继做出了"法治地方"的战略规划,与此同时,"地方法治"一词开始引起学界褒贬不一的热议。而通过思想谱系的考察我们可以发现,学界对地方法治的这两种截然不同的态度,其实是源自中国治理国家的两种传统政治思路,即"封建"与"郡县","地方法治"某种程度上正是中国传统"封建"政治思路的现代表达。在处理"中央与地方关系"的问题上,世界大国普遍采取了联邦制国体,中国是目前世界上唯一实行单一制的大国。然而中国的政治智慧却在于:几千年来,我们独特地发展出了一套"寓封建之意于郡县之中"的多元统治格局,并在建设现代民族国家进程中有效缓解了国家法律与地方性知识之间的紧张关系,用"反现代"的方式解决了现代困境。

In recent years,many provinces make the plan of local rule by law.At the same time,the word of＂local rule by law＂causes argument in the academic circles.If we investigate the ideology pedigree,we can find that the different views of local rule by law are from the different political ideology in traditional China,one is feudal,the other is province and country.Local rule by law is the modern expression of the ＂feudal＂political ideology in traditional China.To solve the question between the central and local,almost all the powers adopt federalism.China is the only power who adopts the unitary system in the world.However,Chinese political wisdom is that we have explored a unique road nearly thousand years,we put the feudal in the province and country.In this way,we cleverly solve the question between the central and local in the process of building Nation-state.
