体育赛事本身不具有版权,所录制的赛事节目享有版权。体育赛事的投资曾主要通过反不正当竞争法获得保护。而赛事举办方通过许可他人录制并直播体育赛事而获得版权的间接利益,再加上门票和广告等收入使赛事举办方的投资可以得到足够的回报。因此,通过不正当竞争法对体育赛事进行额外保护的空间也随之缩小,但这并不排除体育赛事仍然受到反不正当竞争法保护的可能。
Athletic event is not copyrightable itself, but its recording can be protected as audiovisual work by copyright law. Athletic event was protected by unfair competition law. Host of athletic event secures indirect income under copyright law by authorizing broadcast of its event, which ensures adequate compensation by adding the earning of tickets and advertising. Thus, the room of applying unfair competition law to athletic event is decreasing, but the possibility of the application still exist.
