摘要
当前制定和实施市场准入负面清单制度迫切要求先理清负面清单与现行相关管理制度的关系,在此背景下,本文对负面清单与《产业结构调整指导目录》、《外商投资产业指导目录》、行政审批事项、现行法律法规的内在关系一一进行了剖析,并对当前普遍存在的认识误区做了辨析。首先应明确实施负面清单制度的目标是通过列出清单构建透明、公平、开放、依法的市场准入制度,清单内实现透明依法、清单外实现公平开放,清单的制定应独立于《产业结构调整目录》,要按照负面清单制定标准梳理并清理行政审批事项、梳理并修订法律法规,不能将其中有关市场准入的事项或条目不经审查地全部纳入。建议先制定过渡性负面清单,选择部分地区或行业进行试点。
Current draft and implementation of market access negative list system requires to clarify the relationships between the existing management system and the negative list. In this context, this paper does one by one analysis of internal relations between the negative list and the" Catalogue for Guiding Industry Restructuring ",the " Catalogue of Industries for Guiding Foreign Investment" , administrative approval items and existing laws and regulations, and further discriminates some current widespread misunderstanding on the relationships. This paper concludes first that the objectives of the implementation of negative list should be made clear: building a market access system of transparent, fair and open according to the law. The draft of negative list should be independent from the" Catalogue for Guiding Industry Restructuring " Related administrative approval items and existing laws and regulations, which cannot be all included without review, should be sorted and reduced in accordance with the negative list standards. It is recommended to develop a transitional negative list, which can be examined in some selected regions or industry pilots.
