摘要
政府部门普遍以劳务派遣用工方式解决人员编制不足的问题。然而,我国近期出台的旨在限制劳务派遣用工的新规却未将政府部门使用劳务派遣的行为纳入调整范围,立法者的豁免态度极可能诱发政府部门扩大使用劳务派遣的动机。劳务派遣确能为用工单位带来利益,然而,由于政府的公权力机关性质与普通企业存在巨大差异,使用劳务派遣存在承担国家赔偿责任、国库责任的风险,而追偿亦为实践中的难题。在人员编制不足确需使用编外人员的背景下,需要重新审视劳务派遣对政府部门的负面影响,规制其劳务派遣用工的行为。
The government departments generally use labor dispatch to solve the problem of insufficient staffing. However, the new regulations aiming at restricting the labor dispatch do not put the behavior of government using labor dispatch into the adjustment range, which means that it will not be affected by the new regulations, and the legislators' indifferent attitudes may also induce the government departments to expand the use of labor dispatch. Labor dispatch can indeed bring benefits to employment units. However, because there is a huge difference existing between the ordinary enterprises and the government departments, using labor dispatch can have the liability risks of state compensation and national treasury, and the recovery is also a practical problem. Under the background of staffing shortage, it' s necessary to re-examine the negative effects on the government brought by labor dispatch, and then regulate the behavior of using labor dispatch.
