摘要
劳务派遣作为一种新型用人方式以其灵活自主的优势深受各行业青睐,但其复杂的三方主体关系,在实践操作中问题频出。结合2014年3月1日起新实施的《劳务派遣暂行规定》以及事业单位自身特点,针对目前劳务派遣用工的问题,从适法性、派遣机构审查以及管理制度等方面进行风险分析。事业单位应严格审查劳务派遣单位资质、审慎签订劳务派遣协议、完善劳务派遣内部规章制度、并积极做好劳务派遣的日常管理工作,以防范劳务派遣管理风险。
Many industries will choose the labor dispatch as a new way of labor employment with the flexible and independent advantages. However, it brings many troubles in practice because of its complex relations of three bodies. "The New Interim Provisions on Labor Dispatch "(hereinafter short for "The Interim Provisions") was implemented On March 1, 2014. Combined with the characteristics of institutions, it explains the problems of labor dispatch at present.This article analyzes the risk of dispatching management from legitimacy, reviewing the sending agencies and management system. The author suggests that the institution should review the qualification of sending agencies strictly, sign the labor dispatching agreement carefully, perfect the internal regulations. Meanwhile, we should manage the daily work of labor dispatching actively.
