检察机关侦查监督部门如何适应以审判为中心

侦查监督部门是检察机关在刑事诉讼中的把关人,也是冤假错案防线的坚守人。以审判为中心的司法诉讼改革要求侦查监督部门在审查逮捕工作中不断转变刑事司法理念,准确把握侦查监督工作定位,突出审查逮捕的关键性作用,严格把握案件证据标准以保证案件质量。从检察机关审查逮捕实践来看,主要存在检察机关运用证据完整准确认定案件事实、引导侦查取证能力不足,公安机关报捕案件证据质量差、入罪门槛低,侦捕诉衔接出现断层等方面的问题。适应以审判为中心的诉讼制度体系改革,侦查监督部门必须严格把握案件质量关,坚持客观证据主义,推进审查逮捕案件听证审查实践,加强侦捕诉衔接,严防冤假错案。

Investigation supervision department is the gatekeeper of procuratorial organs in criminal proceedings also defensing people of injustice miscarriage. The reform of judicial proceedings centered on trial requires investi-gation supervision department to change concept of criminal justice,accurately grasp the orientation of investigation and prisoning,highlight the key role of review and arrest,and strictly grasp the standard of case evidence to ensure the quality of the case in the review and arrest. From the practice of procuratorial organs in review arrest,there mainly exist the following problems：identification of the case using complete and accurate evidence by procuratorial organs,limited ability to guide the investigation evidence collection,poor evidence for the public security organ to report case,low criminalizing threshold,fault link of investigation,arrest,appeal and so on. To adapt to the re-form of lawsuit system centered on trial,investigation supervision department must strictly grasp the quality of case, adhere to the objective evidence,advance hearing examining practice of review arrest case,strengthen the link of investigation,arrest,appeal and strictly prevent injustice miscarriages.
