行政执法检察监督存在法律依据,权力制衡理论与权力主体适格论,为检察机关行政执法监督提供理论支撑。公安现役部队行政执法存在主体、对象与客体特殊性,重点从立法模式、监督权限、监督方式构建行政执法检察监督,并将公安现役部队纳入其监督范畴。

In this paper, the law basis in administrative law enforcement supervision, the power balance theory and the theory of subject＇s qualification provides the support of theory for the procuratorial supervision over the administra- tive enforcement. The special rules exist for the subject and the object of the administrative law enforcement of the military police. It is necessary to construct the Procuratorial Supervision over the Administrative Enforcement of the military police to form the legislative mode, the supervision authorities and supervision ways.
