摘要
法律纠纷案件影响企业的经济效益、品牌声誉和正常秩序,关乎企业生存发展。案件管理的重点,不是个案暂时的胜负,而应将其置于企业整体战略中进行综合考量,制定符合企业核心利益的应对策略和方案,使案件处理的结果和进度,服从并服务于战略部署。案件管理除了在案件分析、应对策略、庭审程序、案件执行等环节加强管理外,还应当重视事后评估,透过案件处理,分析企业经营管理的现实和潜在风险,提出防范建议,提升企业法律纠纷案件管理的附加值,实现企业利益最大化。
The legal dispute is influential on the profit, reputation and order, even the survival and development of an enterprise. The key point of the case management is not winning an individual case, but designing a proposal according to the core interest of an enterprise in order to make the progress and outcome of a legal dispute case synthetically subject to the whole strategy of an enterprise. On one hand, it is important to strengthen the case analyzing, counter-measure making and to reinforce on the court hearing and the enforcement; on the other hand, it is more important to analyze the risk in the enterprise management through the legal dispute ease and to provide the relevant advice afterwards in order to make the legal dispute case management more valuable.
