2013年中文仲裁研究文献综述

本文献综述的对象为中文数据库以及国家图书馆检索到的300多份文献。通过对这些仲裁研究文献的研读和分析，了解2013年仲裁研究的新问题、新观点和新思路，分析仲裁研究的特点和趋势，使读者整体了解2013年中文仲裁研究现状。2013年，中文仲裁研究呈现出选题新、多样化、角度广等特点。研究范围涉及仲裁领域的基本问题、国际投资和税务仲裁、国际公法仲裁及体育仲裁等方面。特别是对《民事诉讼法》中与仲裁有关的修订和国际投资仲裁的议题，展现出中国学者的热情。总体上，2013年我国的中文仲裁研究仍处于理论研究大过实务研究的阶段，未来需要在方法论和国际热点追踪方面有所提升。

This research summaries study over 300 articles searched from Chinese database and the National Library. By reading and analyzing these articles concerning arbitration, studying new questions, ideas and methods as well as the features and trends on arbitration study in 2013, the author endeavors to help readers get a full understanding of the status quo. In 2013, arbitration study takes on these features： new topics, diversity and wide coverage. The contents include： basic questions on arbitration, arbitration on international investment and taxation, arbitration on public international law, sports arbitration and etc. On the topic of modification concerning arbitration matters in Code of Civil Procedure and international investment arbitration, Chinese scholars show their enthusiasm. On the whole, in 2013, China＇s arbitration studies pay more attention to theory rather than practice, and we shall make improvement on methodology and keep track of international central issues in the future.
