患者权益问题是近些年中国社会一个极为突出的问题,有关医患关系、医患纠纷、医患矛盾的案例不断出现,引发社会广泛关注。如何从理论上阐释患者权益的法理基础,以及在患者权益保护方面,国际文件和国内法上有哪些制度规定和保障,是研究患者权益及其保护的基础性工作。患者权益是人权的重要组成内容,具体可以划分为生命权、健康权、获得医治权等等。无论是国际文件,还是中国国内法,都对患者权益进行了制度性规定和保障。如何落实这些制度保障,是较为急迫和关键所在。

In recent years issues around patients rights, such as doctor-patient relationships, disputes and conflicts, are outstanding in China. It is fundamental to explain theoretically the legal basis of patient＇s rights, and delve the institutional provision and guarantee for patient＇s protection in national documents and domestic statutes. The writer holds that as a basic part of human rights, patient＇s rights consist of the right to life, the right of health, the right to receive treatment etc. Both international documents and domestic statutes in China provide institutional stipulation and guarantee for the protection of patient＇s rights. To carry out those regulations is the key to the solution of these problems.
