社会资本理论是以网络、信任与规范为核心要素,对社会秩序生成进行解释的重要的理论范式,在法治建设过程中,社会资本是法治秩序生成的重要的非物质性资源。社会资本理论以均衡为分析视角来探求法律秩序的关系格局、从公平与效率相结合的角度分析法治建设进程以及运用多学科手段探求法治社会的动力机制,实现了对既有的秩序解释范式的超越,并通过减少法律运行成本、增强社会自治的能力以及推动民主的发展与完善方面对法治建设产生了重要的支撑功能。

The social capital theory is based on the core essential factor such as network, trust and norms and it is the important theoretical paradigm to explain the social order how to generate. In the process of rule of law, social capital is the important non-material resources to generate rule of law order. The social capital theory is based on equilibrium analysis perspective to explore the relationship of law and order situation and analysis construction process of the rule of law from the angle of the combination of equity and efficiency and use a multidisciplinary approach to explore the mechanism of the law society. The social capital theory realized the transcendence of the interpretation of the existing order paradigm and it has produced important support function for the construction of the rule of law in contemporary China by reducing the operation cost, enhancing the ability of social autonomy and promoting the development of democracy.
