夫妻一方隐名享有夫妻共有股权的现象在中国普遍存在,一方未经配偶同意私自转让夫妻共有股权给第三人往往会引发夫妻之间的财产权益纷争。对此,司法实践中通常运用善意取得制度来处理。处理夫妻共有股权转让引发的财产权益纠纷应当明晰三个问题,即夫妻可否共有股权问题、夫妻共有股权买受人的"善意"判定问题和股权转让协议是否有效的问题。基于确保合同相对人取得有效债权进而保护交易安全,无处分权人订立的合同应界定为有效合同。

In China, it’s a common phenomenon that one dormant spouse holds the couple shared stocks.When one of the spouses transfers the couple shared stocks to the third person without the other spouse’s agreement, the couple often dispute on property rights and interests.These disputes are usually handled by applying bona fide acquisition system in judicatory practice.When handling the property rights and interests disputes caused by transferring the couple shared stocks, we need to clarify the following three problems that whether the couple can hold shared stocks, the determination of the buyer’s'good faith'and whether the stocks transfer agreement is effective.On the basis of ensuring the contract relative person to obtain effective creditor’s rights and protecting transaction security, the contract concluded by people who have no right to dispose should be defined as an effective contract.
