A Brief Discussion on the Criterion for Breaching Expert's Duty of Care in Tort Law——Focusing on Doctor's Duty of Care

随着越来越多的侵权纠纷的产生,"专家的注意义务"一词越来越受到学界的关注。"专家的注意义务"和一般普通的注意义务之间的联系,在大陆法系和英美法系国家的法学理论和司法实践中已经形成了一整套较为成熟的判断标准和判断体系。作为一种专门行业或专业领域的注意义务的认定标准,需要根据技术职务来确定,同时还需要与时俱进,符合现今的技术水平以及时代的要求。

With increasing specialist-related tort disputes, the term of ＂expert＇s duty of care＂ has aroused wide concern of the academic circle. The countries under the civil law system and the common law system have developed a set of relatively complete criterion and systems for distinguishing between expert＇s duty of care and ordinary duties of care through legal theoretical study and judicial practice. Setting up the criterion for doctor＇s duty of care should take into account the doctor＇s technical posts, keep pace with the times and suit the technology level as well as the requirements of the times.
