在信息网络化时代,数字技术对传统的版权合理使用制度带来了巨大冲击,产生了一系列问题,使之难以适应数字图书馆的发展需要。这就需要立法机关根据有关理论,构建数字图书馆合理使用的基本原则,明确数字图书馆合理使用的判断标准,设置一个新的平衡版权各方利益的合理使用制度,以确保版权各方当事人的合法权益,促进数字图书馆文化传播功能的充分发挥。

In the era of information network, the digital technology has brought great impact on the traditional copyright fair use system and has caused a series of problems, so traditional copyright fair use system can＇t meet the needs of digital development. The legislature needs to explore the basic principles of digital library fair use according to the relevant theories, confirm the judging standards of it and set up a new system which ensures a balance of interests, aiming at promoting the full play of cultural transmission functions of digital library.
