论北方海航道航行中程租合同条款的约定——以中俄强制性法律规范之考察为视角

The Articles of Voyage Charter Party in the Navigation through the Northern Sea Route from the Perspective of the Study of the Compulsory Articles of Chinese-Russian Laws

随着北极冰融,北极通航成为现实。毗邻俄罗斯的北方海航道具备大规模商业通航的自然优势。北方海航道开通后,中俄抑或中欧间取道北方海航道的贸易往来将急剧增加。在此背景下的海上货物运输将不可避免地涉及到中俄两国相关国内法的适用,程租合同中当事人必须遵守的强制性法律规范尤其应引起重视。以北方海航道航行为背景,有必要对准据法的适用、中俄有关海上货物运输合同的强制性法律规范进行考察。程租合同双方可在强制性法律规范边界外通过利益博弈约定彼此的权利义务,实现利益均衡。

As the Arctic sea ice melts , the passage through the Arctic is becoming possible . The Northern Sea Route adjacent to the Russian coast area could satisfy large‐scale commercial transportation . After the opening of the Northern Sea Route ,the Sino‐Russian or Sino‐European trade will be greatly in‐creasing .Under the development scenario ,the carriage of goods by sea will inevitably involve the applica‐tion of both Chinese and Russian law s ,in w hich the compulsory articles should draw more attention .For those carriages of goods by sea through the Northern Sea Route ,it is necessary to analyze the applicable law and the compulsory articles regulated by the Chinese and Russian laws .After a comparative study of the articles under standard voyage charter forms and compulsory articles stipulated by Chinese and Russian laws ,relevant suggestions will be given for Chinese interested parties for their own sake .
