我国农民参与农村生态保护的法律困境与出路

The Legal Plight and the Outlet of Farmers Participation in Rural Ecological Protection

农民参与农村生态保护是参与式民主理论、生态正义理论和公共物品理论的必然要求。当前,农民参与农村生态保护的现状表现为参与意识低、参与缺乏组织性、参与范围狭窄等方面;在法律上存在立法上未确立农民的生态权、我国农村生态保护的法律体系不完善、农村环境资源的产权关系未明晰等困境。因此,需要从立法上明确农民的生态权、完善农村生态保护的法律体系、明晰农村环境资源的产权、建立环境信息公开制度等方面切实保障农民参与农村生态保护。

The farmers＇ participation in rural ecological protection is an inevitable requirement, of the theory of participatory democracy, the theory of ecological justice and the theory of public goods. At present, the current situation of farmers＇ participation in the rural ecological protection is the low participation awareness, lack of organization participation, the narrow scope of the participation and so on. There are some difficulties in the legal system, for example, the legislation does not establish the existence of ecological rights of farmers, the legal system of rural ecological protection is imperfect and the property rights of the rural environment resources are not clear. Therefore, we need to clear the ecological rights of farmers in legislation, to improve the legal system of rural ecological protection, clear the property rights of rural environmental resources, and establish environmental information disclosure system and other aspects to effectively protect the farmers＇ participation in rural ecological protection.
