用户生成内容的版权侵权问题治理模式研究

Research on the Governance Model of the Copyright Infringement of User-Generated Content

目前,国外对于用户生成内容版权侵权问题的治理主要有两种模式:用户生成内容服务商指导原则所倡导的治理模式与知识共享模式。这两种模式表现出各自的特点和缺陷。用户生成内容服务商指导原则所倡导的治理模式证实了过滤识别技术的重要性并证明其需要人工干预;知识共享模式证明了这种灵活的版权授权方式能在现有版权制度下促进信息共享。然而,用户生成内容服务商指导原则所倡导的治理模式凸显了技术的局限性;两种治理模式都存在执行力问题并且应用范围非常有限。

There are two solutions to settle the copyright infringement of user-generated content in foreign countries at present： model initiated by principles for user-generated content services and creative commons model. Each one shows its own characteristics and defects. It＇s proved by the former model that content identification technology is vital and also needs human intervention. The latter model demonstrates that the flexible copyright licensing way could promote the information sharing under the present copyright system. However, some disadvantages are exposed, such as technical limitation of the model initiated by principles for user-generated content services, and shortcomings in the execution and the application scope of both of two models.
