最高人民检察院发布的部分指导性案例引用了法院裁判结果,其结构表现为"叙述性诉讼过程+定罪标准和处罚原则要旨"。这种结构在体现检察监督职能得以运用的同时,表明了对法院裁判的认可,保障了司法裁判的稳定性,进而有效地整合了检察院、法院和当事人通过诉讼过程形成的共识,并形成规范效力,从而在提高司法裁判合法性的同时,增强了裁判的可接受性。

Some guiding cases that the Supreme People's Procuratorate of the People's Republic of China issued have quoted parts of courts decisions,in which the structure goes as follows: narrative litigant content,standard of conviction and principle of punishment. This structure shows the operation of procuratorial supervision,illustrates the acception of courts decisions,ensure the stability of courts decisions,all of which leading to the effective integration of consensus between procuratorates,courts and litigants formed in litigation. By this way,the norm effect is generated,the validity and acceptability of courts decisions is improved.
