我国技术标准与专利结合现状的问题分析

知识经济时代,技术标准与专利结合的趋势越来越明显,将专利技术纳入到技术标准,成为世界各国的标准化战略。技术标准与专利的结合过程中也存在许多冲突,本文分析了世界标准化组织和我国标准化管理机构的专利政策,并就不足之处提出相应的建议。

In the era of knowledge economy, it is an obvious trend that technical standards are combined with the patents. That patented technologies being utilized in technical standards has become a standardization strategy in the world. There are several conflicts existing when technical standards bond with patents. This thesis analyzes the patent policies which adopted by international standardizations and domestic standardization management institutions, and put forward some suggestions concerning the shortage of them.
