摘要
只有通过制度的完善,才能预防并纠正控制性详细规划中的主观随意性,并使社会各利益主体对控制性详细规划中开发强度等强制性指标的合理利益诉求获得"申诉"渠道,从而避免频繁修编,真正体现控制性详细规划的法定效力。文章通过对澳大利亚新南威尔士州环境规划法体系的解读,提出新南威尔士州建立州环境规划政策体系、制定重大开发规划政策和开发指标"申诉"政策,以及划分详略分区防止"过度规划"等具体的制度设计,是体现自上而下的规划管控以及自下而上的利益"申诉"的重要措施,对完善我国规划机制具有借鉴意义。
Mechanism may prevent arbitrariness in regulatory planning, guarantee the appealing of different social stakeholders, and thus avoid frequent revisions as a statutory instrument. The paper analyzes environment planning law system of New South Wales, and introduces the institutional design such as major development planning policy, appealing policy, and detailed-sketchy zoning distinction. The institutional design is important in the connection of top-down governance and bottom-up appealing, and it is valuable to China's planning mechanism development.
