惩罚性赔偿金适用标准及完善

The Applicable Standard of Punitive Damages and Its Improvement

《中华人民共和国消费者权益保护法》新增了一种典型的惩罚性赔偿,明确了惩罚性赔偿金三倍标准。但是当前以"商品价款"或"服务价款"及"相应的赔偿"为指导原则设立的规则忽略了惩罚性赔偿案件中赔偿金的特殊性,造成了惩罚性赔偿金法律适用的困境。因此,未来惩罚性赔偿金赔偿标准应当附条件设立惩罚性赔偿金上限,系统设置参考因素及设立惩罚性赔偿保险基金、公益基金。

A new typical punitive damages which defines the three-time standard of punitive damages was added to the Consumer Protection Law of People＇s Republic of China.However,the current regulations within the guideline of commodity price or service price and the corresponding compensation ignore the particularity of damages in the punitive compensation cases,which leads to the dilemmaof law application of punitive damages.Therefore,the future compensation standard of punitive damages should set the punitive damages ceiling with additional conditions,offer systematic reference factors and set up insurance fund and commonweal fund for punitive damages.
