摘要
在现代社会,衡量一个社会的民主化程度,主要是看这个社会对权利的法律规定。看一国之法是否先进首先是看这个社会是以权力为本位还是以权利为本位的,这是立法的根基。本文从权利的法律保障、权力的法律制约以及权利与权力的关系三个方面,对《中华人民共和国集会游行示威法》进行简要的分析,讨论了在现代社会中,权利与权力的制衡机制在《中华人民共和国集会游行示威法》中的运用。
In the modern society,measuring the degree of democratization in a society mainly counts on the legal provisions of the rights,while judging legislation of a country firstly lies in power-orientation or rights-orientation in the society,which is the foundation of legislation.The essay executed simplified analysis on the Law of the People＇s Republic of China on Assembles,Processions and Demonstrations from three aspects of legal guarantee of rights,legal restriction of power and the relationship between rights and powers,and the discussed balance institutions applied in the Law
