城中村回迁安置社区的法律治理困境与出路

Predicament and Outlet of Legal Governance in the Village Resettlement Community in Cities

近些年来,随着城市的扩张,城市中安置社区的数量逐年增加,此类社区的多样性、复杂性使社区管理成为目前城市社会管理中一个十分棘手的问题。安置社区作为一种过渡型社区,是徒有社区外壳的"新城中村"。村民社会角色难以转换,社会保障制度不接轨,法律、制度的缺位造成村转居过程中城乡制度的转轨难以顺利进行。因此,尽快建立一套具有起承转合功能的基层社会自治基本法规体系,构建党委领导、街道(居委会)组织引导实施、社会中介组织协同、公众参与的社会管理新格局,是实现安置社区向城市社区有序过渡和衔接、促进经济社会快速健康协调发展的重要举措。

In recent years,with the expansion of cities,the number of resettlement community in cities has increased year by year. As a result,complexity and diversity of such communities has made community management very difficult in the social management of a city. Resettlement community is a community housing ＂new village＂as a transitional community. The social roles of villagers are difficult to convert; the social security system is hard to connect and lack of law and institution makes institution transition from countryside to city difficult to proceed smoothly. Therefore,we must establish a set of the basic laws and regulations of grass-roots social autonomy with coherence function,build a new pattern of social management with the leadership of Party committees,guidance and implementation of street（ neighborhood）,cooperation of social intermediary organization and public participation to realize orderly transition and connection from resettlement community to city community and to promote economic society to develop rapidly and harmoniously.
