基于技术创新的高校知识产权确权制度研究

Study on Intellectual Property Right System Based on Technology Innovation

一项资源实现其价值需要满足边界清晰和产权明确等条件,技术变革缓慢的主要原因在于未能创新一整套所有权。知识产权确权就是确定知识财产的所有权归属。高校知识产权确权是检验其技术创新能力的关键指标。对职务技术成果、财政资助项目技术成果、协同创新技术成果、在校学生技术成果权利归属确定的法定原则进行了分析,针对高校知识产权提出相应的创新性的权属制度规则,以期望高校创新和完成人权益保护的双赢。

Taking considerations of clear boundary,clear property rights and other vital conditions can be the access to realize the values of resources. The major reason which leads to slow development of technology revolution is the inabilities of innovating in a novel series of ownership. Besides,the intellectual property rights can be used to recognize the ownership of intellectual properties. And the academic intellectual property right is a pivotal indicator to test the technological innovation ability of that. In addition to analyzing piles of factors in this dissertation,including job related technological achievements,project supported by the financial and achievements,collaborative innovation and technological achievements and the statutory principle of student rights of technical achievements identified,the author even came up with some accordantly novel suggestions of ownership which aims at colleges and universities,hoping the academic innovation and rights protection of inventors can maintain in a win- win situation.
