摘要
法官绩效考评制度建构的目的在于提高审判的质量、效率和效果,是保障司法公正实现的重要机制之一。由于该制度采用了自上而下设定指标(最优)的机制来加以推进实施,导致法官(院)自主性逐渐丧失。在指标最优的中轴原理下,法院与法官成为利益互惠共同体,法院渐渐地远离自身本质,使得法官的策略行动能得以展开,最终结果则是司法公正的丧失。为此,既有必要研究法官策略行动为何需要和如何得以可能的逻辑,也有必要对指标最优的中轴原理加以反思,并从法治理论构造角度出发重视中轴原理所具有的分析能力和学术价值。
The appraisal system of the judge's performance aims to improve the quality,efficiency and effect of the trial,which is an important mechanism to guarantee judicial justice. However,since such system adheres to a top- bottom method to set index( optimal) mechanism so as to promote the implementation,the autonomy of the judge( or courts) is gradually decaying. According to the axial principle for optimum index,courts and judges have become mutual benefit community. As a result,the court has gradually deviated from its essence so the judge can make strategic action and the final consequence is loss of judicial justice. Therefore,it is necessary to study the reason and logic of feasibility of the judge's strategic action as well as to reflect on the axial principle for optimum index,and further to evaluate the analytical capacity and academic value of the axial principle from the perspective of constructing the rule of law.
