关于《农民专业合作社法》修订若干问题研究的文献述评

Literature Review and Preliminary Study on Key Issuses of Farmers Specialized Cooperative Law Revision

借助CNKI期刊论文数据库,对2007年1月至2015年4月在经济学和法学门类下发表的关于农民专业合作社法修订的相关研究文献进行梳理。学术界主流在充分肯定《农民专业合作社法》里程碑意义的同时,对若干重点焦点问题产生争鸣。将其归为五个方面:以土地股份合作社为焦点的法律覆盖范围问题,以强调明晰成员边界和细化成员权责为重点的成员资格及权利义务问题,以完善合作社独立法人财产权为重点的财产权属性问题,以完善公积金制度和建立按要素分配的收益分配原则为重点的盈余分配问题,以及与《反垄断法》等其他相关法律有效衔接问题。文章对相关问题进行主要观点介绍、归纳与评述,并提出作者的看法。最后指出《农民专业合作社法》的修订应从完善社会主义市场经济法律体系的战略高度,秉承其立法的精神实质和所要体现的社会价值。

With the help of CNKI retrieval tools, during April 2015 to January 2007, we carried on a review of the relevant research literatures on the revision of the Farmers＇ Professional Cooperatives Law under the category of economics and law. The academic mainstream fully affirmed the farmers＇ specialized cooperatives law of landmark, at the same time, some key issues in the schools of thought contended. The paper classified them into the following five aspects, the legal coverage rounding land stock cooperatives, the boundary of the and refine members＇ rights and obligations, independent legal property right of farmer cooperatives, the improvement of the accumulation fund system and establishing new principle of surplus distribution emphasizing on the ＂factor contribution＂ and the effective connection with the anti-monopoly law as well as other relevant legal problems. Main academic view points and views of the above problems were summarized and reviewed. Finally, the paper pointed out that the farmers＇ professional cooperatives law revision should adhere to the strategic height of uphold its legislative spirit and social value. perfecting legal system of socialist market economy and
