反律法主义命题下的证据问题思考——以DNA证据规则的完善为例

On the Evidence Issue in Antinomianism

反律法主义命题的阐释源自边沁对证据法的衡量与评价。基于对普遍认知能力的依赖以及对还原事实的逻辑推理认定,边沁在审判方面强调事实认定重要性的同时,也表现出对证明自然体系的偏好。反律法主义命题最终走向了放轻证据规则、偏重证明程序的矛盾对立面。以DNA证据为例,当DNA证据所指向、确认的事实出现时,是否仍然需要对该类证据规则进行严格限定。借助证据规则的理性完善主义对现行DNA证据规则进行补强,在解决问题的同时也回到了反律法主义追求事实正义的目标之中。

Antinom ianism was derived from Bentham who measured and evaluated law of evidence. Based on the dependence on general cognitive ability, and restoring the truth of logical reasoning, Bentham emphasized the importance of fact finding in terms of trial, and meanwhile also showed the preference for the natural system of proof. Antinomianism ended up in contradiction of lightening evidence rules and highlighting proof procedures. Taking DNA evidence for example, when the fact pointed to and confirmed by DNA evidence occurs, the question is whether we still need to strictly lim it the rules of this kind of evidence. With the aid of evidence rules of rational perfection to reinforce the existing DNA evidence rules, we solve the problems and reach the goal of quest for truth, justice pursued by Antinom ianism.
