摘要
党的政策创新提出了矿山企业可直接获取农村集体土地,对于如何获取和使用农村集体土地,继续从制度安排上进行探索。矿业用地生态性、变动性、复杂性的特点决定了矿业用地方式的多元化选择:首选股份合作、次选租赁、慎选入股与出让、普选地役权与相邻权。这些方式均属集体土地权利让渡,承包经营者是让渡的基本主体;承包经营权分解为承包权与使用权,让渡的是物权性土地使用权,与国有土地使用权同权同价。提出农村矿业用地应通过土地利用的市场准入制施行严格的用途管制,制定土地利用专项规划与矿业开发规划衔接以确定矿业用地指标,利用土地增减挂钩方式换取建设用地面积。
