商业性代孕背离了"人是目的"的道德原则,损害了代孕妇女、代孕婴儿的生命尊严、人格尊严以及人类尊严。亲属间的援助性代孕和针对某些特殊不幸家庭的志愿者代孕符合生命伦理原则和人道主义精神。鉴于中国女性丧失生育能力者众多、地下非法代孕猖獗、代孕妇女和婴儿的尊严和人权受到严重威胁的现状,在加大打击商业性代孕的同时,可先行谨慎开放亲属间的援助性代孕。
