摘要
所谓的优先购买权就是在法律的保障下,当出卖的人在出卖某种物品,而出现了第三方购买人时,这样的条件下购买的权利却高于第三方购买人的权利。目前就我们国家的法律法规而言,这种房屋租赁的优先购买权还是存在很多的不完善的部分,所以在实际的应用中还存在着诸多的问题。以下就是笔者分析了我们国家这一制度实际的发展情况,通过充分的研究提出一些个人的建议和完善的方法。
The so- called right of first refusal is under the protection of the law,when people sell certain items to sell and the emergence of a third party purchaser. The right to purchase under such conditions is higher than the right of a third party purchaser. In terms of the laws and regulations of our country at present,there are still a lot of imperfection of the preemptive right of house lease,so in the actual applications,there are still many problems. The following is the author's analysis of the actual situation of this system in our country,through adequate research to give some personal advice and perfect method of lessee preemption system.
