指定居所监视居住的监督主体研究

Research on the Subject of Supervision for the Assigned Residence under Surveillance

2012年《刑事诉讼法》新增第73条对指定居所监视居住的适用条件、适用对象等做了较为详细的规定。作为一项新出现的刑事强制措施,无疑需要确定监督主体,建立完善的监督体系,保障这一强制措施的顺利实施。目前我国对于指定居所监视居住的监督主体还存在缺陷,需要将被害人的监督和媒体的监督纳入到监督体系中,建立七位一体的监督格局。

The additional Article 73 of ＂ Code of Criminal Procedure＂ has made a more detailed provisions for the applicable conditions and objects for the assigned residence under surveillance. As a newly emerging criminal coercive measures,undoubtedly we need to identify the supervisors,establish and improve the supervision system to ensure the smooth implementation of the mandatory measures. At present,China is also flawed for a specified residence under surveillance,we need to monitor and supervise the victim of the media into the monitoring system,the establishment of seven integrated supervision structures.
