论合理行政原则在公众聚集场所投入使用、营业前消防安全检查中的运用

On the Practice of Rules of Reasonable Administration into Public Gathering Places,and into Business Fire Safety Inspection Before Their Operating

《消防法》于2008年修订后明确增加了对公众聚集场所在投入使用、营业前的消防安全检查。该法律条款的增加有利于进一步加强公安消防部门对公众聚集场所消防安全的监管,从而减少消防安全隐患和火灾的发生。以合理行政原则为出发点,结合对该法律规定的社会实效性问题的考虑,探讨如何将该法律条款更合理地适用于消防执法,以便更好地为加强社会消防管理服务。

The revised Fire Law clearly stresses the fire safety checks on public gathering places before their operating. The stress is beneficial to strengthen the public security by fire departments,thereby reduce fire risks. This paper uses reasonable administration rules as a starting point,considers the combination of the effectiveness of the law,explores how the legal provisions are used more reasonably for fire protection law enforcement,in order to better fire management and to strengthen the social services.
