随着民间公益蓬勃发展,民法尤其是民事主体制度对于公益组织进行重新审视成为必然。构建公益组织民事主体制度首先需要解决的问题是影响法律对公益组织民事主体定性的因素。通过回溯外国民事主体制度的构建历史,可以明晰对某一社会存在的民事主体定性影响因素是经济社会发展水平、区域文化发展水平尤其是公民意识水平、权利理论与组织理论发展水平、社会存在自身发展水平等,并运用这一规律揭示我国公益组织民事主体定性困境产生的原因。

With the vigorous development of non-governmental commonweal organization, there is a necessity for civil law, especially the civil subject system, to take a re-examination of commonweal organization. Solving the problem that affects identifying the civil subject of the commonweal organization is the first step to construct the civil subject system of the commonweal organization. By tracing back the history of civil subject system in foreign countries, we can make clear that the qualitative influence factors lie in the level of economic and social development, the level of regional cultural development, especially the level of citizen consciousness, the development level of the right theory and organization theory, and the development level of the society, which can reveal the reasons for the difficulties we meet in identifying the civil subject of the commonweal organization.
