The Private Right Nature of the Right of Personal Information

文章以个人信息的权利属性为视角,分析个人信息的法律保护问题。个人信息对于人格尊严、自我认同具有重要意义,因此其首先是一种人格权;同时,个人信息在流通过程中表现出财产价值,因而个人信息权也是一种财产权。由于个人信息的首要价值目标是维护人格尊严,因此,个人信息权本质上是一种蕴含着财产权的人格权。

With the perspective of the nature of the right of personal information,the legal protection for personal information is concerned. Personal information is of great value to personal dignity and self-identification so it is first of all right of personality. Since it is related to personal property it is also a property right. Considering the priority of dignity protection,it is in nature the personality rights with property right factors.
