《物权法》术语“占有”的内涵及英译辨析

Analysis on the English Translation of Real Right Law Term “zhanyou( 占有)”

中国《物权法》中的术语"占有"在概念上存在着一定的逻辑缺陷,这个缺陷不仅妨碍了人们正确理解"占有"的内涵,同时也会对该术语的英译产生负面影响。文章基于术语学中有关术语系统内部逻辑一致性的原理,评析了术语"占有"的英译,并提出了建议的译法。

ln addition to translation principles, terminology principles should also be applied in term trans-lation. We analyze the logic defect in the term system of Real Right Law of P. R. China, which not only hampers people’s comprehension of the term“zhanyou (占有)”, but has negative effect on its English trans-lation. Moreover, we review the established translation and put forward the author’s suggested translation.
