Pros and Cons of the Anglo-American Anti-terrorism Legislation and Its Implications

近年来,恐怖活动在国际范围内呈现出愈演愈烈之势。在国内,加强反恐立法、严惩恐怖犯罪的呼声日益高涨,一部系统的反恐怖主义法律已呼之欲出。在国外,自"9·11"事件后,英美国家应急性地制定了一系列反恐法律,有成功亦有教训。英美反恐立法正反两方面的经验启示我们,反恐措施应纳入法制化、规范化的轨道;反恐立法可适当限制个人自由,但不能倒向极端的社会本位;反恐不能搞民族、宗教信仰歧视;应制定系统的反恐法律,实现全方位的预防;对恐怖主义要采取严格的刑事政策,同时,应注意设置出罪机制。

In recent years, terrorist attacks in our country are getting increasingly seriousness andhave spread from border areas to the mainland. The voice of strengthening anti-terrorism legislationand punishing terrorist crimes seriously is rising. Therefore, it can be predicted that a comprehensivecounter-terrorism law will be made in foreseeing future. After the '9.11' incident, US and Englandhave developed a series of anti- terrorism laws in an emergency manner, which have successes aswell as failures. Both positive and negative aspects in Anglo-American anti-terrorism legislation haveenlightened us that anti-terrorism measures should be incorporated into the legal system and standard-ized track, anti-terrorism legislation can tend to social selfishness but not to extreme social selfish-ness, we can't engage in racial and religious discrimination, and we should develop a comprehensivecounter-terrorism law so as to achieve a prevention toward all domains. In addition, when we crimi-nate terrorismin the anti-terrorism legislation, we should pay attention to setting out the mechanismof non-criminal.
