民办学校的依法治理

The Governance of Private Educational Institutions by Law

民办学校法律关系比公办学校更为复杂。在全面依法治国的背景下,民办学校要坚持社会主义办学方向,贯彻国家教育方针,以制定章程、完善法人制度、健全治理结构为重点,全面推进依法治理,构建政府依法管理、学校自主办学、社会依法参与的治理格局。国家要通过修改完善民办教育法律法规,为民办学校依法治理提供制度支撑。

Legal relations of private educational institutions are more complicated than those of public educational institutions. In the process of realization of rule by law in China, private educational institutions must adhere to the direction of socialism and follow policies of governments. They should make charters, establish corporation structure, optimize governance structure in order to fully promote the idea of rule by law and achieve the goal of governance by law, management by autonomy, and participation by the public. Governments should amend and improve laws and policies on private education to offer institutional support.
