摘要
如何以法治的精神和原则来完善高校内部的学生纪律规范及其纠纷解决机制是推进我国高等教育法治的重要内容。通过对美国加州大学伯克利分校相关制度分析,发现美国高校学生纪律规范及纠纷解决机制存在如下五个突出特点:第一,重视发挥校内纠纷解决机制的作用;第二,鼓励使用调解等非正式机制;第三,恪守正当法律程序原则;第四,强调听证的独立和多方参与;第五,尊重学生的隐私权。
Improving student disciplinary regulation and dispute resolution system, based on the rule-of-law spirit and principle, is one critical content in China higher education rule of law. This article takes University of California, Berkeley Campus as example. It brings forward five major characters of student disciplinary regulation and dispute resolution systems in U.S. higher education institutions for reference, which includes: 1. Attaching great importance to the role of internal dispute resolution system; 2. Encouraging the use of informal dispute resolution and likewise; 3. Adhering faithfully to the principle of due process of law; 4. Underlining independence and multi-participation in hearing; 5. Respecting students' privacy right.
